TOMASIK KOTIN KASSERMAN OBTAINS VERDICT PROVING NEGLIGENCE IN PREMISES LIABILITY CASE
James P. McKay and Philip P. Terrazzino of Tomasik Kotin Kasserman obtained a $214,751.22 verdict against Advocate Health and Hospitals Corporation on behalf of a man injured after he slipped and fell in the family changing room at a local fitness center.
A jury in Cook County reached the result in favor of George Kleemann, now 79, following a trial in the Daley Center before Judge Thomas More Donnelly. The case involved the failure of Advocate Health and Hospitals Corporation to maintain the bathroom at its fitness center. George Kleemann, then 75, was using the facility to recover from a recent back surgery. When he entered the family changing room, he slipped and fell on water that had accumulated on the tile floor. The impact of the fall caused George to fracture his hip.
The jury found that Advocate Health and Hospitals Corporation failed to keep its family changing room safe and free of hazards.
